1. About the program
The Oil Painting Hub Affiliate Program (the Program) is operated by Isabelle Larin Web Services (the Company, we, us, our), trading as The Oil Painting Hub, based in Otterburn Park, Quebec, Canada. The Program is managed through FluentAffiliate, a third-party affiliate management platform.
These Affiliate Program Terms and Conditions (the Agreement) govern your participation in the Program as an affiliate (Affiliate, you, your). By applying to or participating in the Program, you agree to be bound by this Agreement in its entirety. If you do not agree, do not apply or participate.
This Agreement is in addition to, and does not replace, the general Terms of Use of The Oil Painting Hub website, which continue to apply.
2. Eligibility and application
Participation in the Program is by application only. We reserve the right to approve or reject any application at our sole discretion, without obligation to provide reasons. Approval of an application does not create any guarantee of continued participation.
To be eligible, you must:
- be at least 18 years of age or the age of majority in your jurisdiction, whichever is higher;
- have a valid bank account or be able to receive e-transfer payments;
- have an active online presence (website, blog, social media, newsletter, or similar platform) through which you will promote our courses; and
- comply at all times with this Agreement and all applicable laws.
We reserve the right to terminate your participation in the Program at any time, with or without cause, and with or without notice.
3. Affiliate links and tracking
Upon approval, you will receive a unique affiliate tracking link (your Affiliate Link) generated through FluentAffiliate. You must use your Affiliate Link for all promotions in order to be credited for referrals.
Our tracking cookie window is 30 days. This means that if a visitor clicks your Affiliate Link and completes a purchase within 30 days of that click, the sale will be attributed to you, provided no other affiliate link was clicked more recently. We do not guarantee tracking in all cases, including where a visitor uses a private browser, clears their cookies, or uses a different device.
You are responsible for ensuring that your Affiliate Link is correctly formatted and functional. We are not responsible for lost commissions resulting from broken, incorrectly used, or modified links.
4. Commissions
Commission rates – You will earn commissions on qualifying purchases made through your Affiliate Link at the following rates:
- 30% of the net sale price for each qualifying purchase, from the date your application is approved;
- 40% of the net sale price for each qualifying purchase, once you have successfully referred a cumulative total of 8 qualifying purchases through your Affiliate Link.
Commission rate upgrades take effect from the next qualifying purchase after the 8th referral threshold is reached. We will notify you by email when your rate is upgraded.
Qualifying purchases – A qualifying purchase is a completed, paid, and non-refunded purchase of a course through your Affiliate Link within the 30-day tracking window. Commissions are not earned on purchases that are subsequently refunded, charged back, or cancelled.
No self-referrals – You may not use your own Affiliate Link to purchase courses for yourself or for people in your immediate household. Self-referral commissions will be forfeited.
Commission adjustments – If a referred purchase is refunded or charged back after a commission has been recorded, the corresponding commission will be deducted from your account balance. If this results in a negative balance, it will be carried forward and offset against future earnings.
5. Payouts
Commissions are paid out on a quarterly basis, at the end of each calendar quarter (approximately March 31, June 30, September 30, and December 31). Payments will be processed within a reasonable time following the close of each quarter.
A minimum account balance of CAD 80.00 is required to trigger a payout. If your balance does not reach CAD 80.00 by the end of a given quarter, your earnings will roll over to the following quarter and accumulate until the threshold is met.
Payments are made by bank transfer or Interac e-Transfer to the payment details you have provided in your FluentAffiliate account. You are responsible for providing accurate and current payment information. We are not responsible for failed or misdirected payments resulting from incorrect information provided by you.
All amounts are in Canadian dollars (CAD). You are solely responsible for any taxes, duties, or levies applicable to your commission income in your jurisdiction. We do not withhold taxes on behalf of Affiliates.
6. Promotional obligations and conduct
As an Affiliate, you agree to promote The Oil Painting Hub courses honestly, accurately, and in a manner consistent with our brand. In particular, you must:
- only make truthful and accurate statements about our courses and not misrepresent their content, quality, price, or any other feature;
- clearly and conspicuously disclose your affiliate relationship with us in all promotional content, in accordance with applicable advertising and disclosure laws (including the Canadian Competition Act and applicable guidelines from the Competition Bureau of Canada). A disclosure such as “This post contains affiliate links. I may earn a commission if you purchase through my link” is required;
- not engage in any form of spam, including unsolicited mass emails, comment spam, or posting affiliate links in forums or communities where such promotion is prohibited;
- not use paid search advertising (including Google Ads, Meta Ads, or similar platforms) that targets our brand name, domain, or trademarked terms;
- not create websites, social media profiles, or other online presences that could be mistaken for our official channels or that use our name, logo, or branding without our prior written consent;
- not promote our courses on coupon, deal, or cashback websites without our prior written consent;
- not engage in cookie stuffing, click fraud, or any other manipulative, deceptive, or artificial means of generating traffic or inflating referral counts;
- not place your Affiliate Link on any website or platform containing illegal, adult, offensive, discriminatory, or otherwise objectionable content; and
- comply with all applicable laws and regulations, including privacy, anti-spam (Canada’s Anti-Spam Legislation – CASL), and advertising standards laws.
7. Intellectual property and use of our brand
We grant you a limited, non-exclusive, non-transferable, revocable licence to use The Oil Painting Hub name, logo, and approved promotional materials (Brand Assets) solely for the purpose of promoting our courses through your Affiliate Link in accordance with this Agreement.
You must not modify, alter, or create derivative works from our Brand Assets. You must not use our Brand Assets in any way that suggests endorsement of your personal views, products, or services, or in any way that could damage our reputation.
We may update our Brand Assets or usage guidelines at any time. Upon notice, you must promptly update your promotional materials to reflect any changes.
All intellectual property rights in our Brand Assets and course materials remain exclusively ours. This Agreement does not transfer any ownership rights to you.
8. Relationship of the parties
You are an independent contractor. Nothing in this Agreement creates or implies any employment, agency, partnership, joint venture, or franchise relationship between you and us. You have no authority to enter into any agreement or incur any obligation on our behalf.
You are solely responsible for your own business operations, expenses, taxes, and compliance with all laws applicable to you.
9. Term, suspension and termination
This Agreement begins on the date your application is approved and continues until terminated by either party.
Termination by you – You may terminate your participation in the Program at any time by notifying us at info@oph.art. Termination takes effect upon receipt of your notice.
Termination or suspension by us – We may suspend or terminate your participation in the Program at any time, with or without cause, by providing notice to the email address associated with your FluentAffiliate account. We may terminate immediately and without notice if we determine that you have breached this Agreement, engaged in fraudulent activity, or acted in a manner that could harm our reputation or business.
Effect of termination – Upon termination: (a) your Affiliate Link will be deactivated; (b) you must immediately cease all use of our Brand Assets and remove all Affiliate Links from your platforms; (c) any earned commissions that have met the minimum payout threshold will be paid out at the next quarterly payout date, provided no fraud or breach is involved; and (d) any commissions that have not met the minimum threshold will be forfeited.
10. Modifications to the Program
We reserve the right to modify, suspend, or discontinue the Program, or to change commission rates, payout thresholds, payout schedules, or any other terms of this Agreement, at any time. We will endeavour to provide reasonable advance notice of material changes by email or through your FluentAffiliate dashboard.
Your continued participation in the Program after the effective date of any changes constitutes your acceptance of the modified terms. If you do not agree to the changes, you must terminate your participation before the effective date.
11. Disclaimers and limitation of liability
The Program is provided “as is”. To the maximum extent permitted by law, we make no representations or warranties regarding the Program, FluentAffiliate, or the amount of commissions you may earn. Affiliate earnings are not guaranteed.
To the maximum extent permitted by applicable law, we will not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, or business opportunities, arising out of or in connection with this Agreement or your participation in the Program, even if we have been advised of the possibility of such damages.
Our total liability to you under this Agreement, for any reason and regardless of the form of the action, will not exceed the total commissions paid to you in the three months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your participation in the Program; (b) your breach of this Agreement; (c) your promotional activities; or (d) your violation of any applicable law or the rights of any third party.
13. Privacy
By participating in the Program, you acknowledge that we will collect and process certain personal information about you (such as your name, contact details, and payment information) for the purpose of administering the Program. This information is also processed through FluentAffiliate in accordance with their privacy policy. Our collection and use of your personal information is subject to our Privacy Statement and applicable Canadian privacy legislation, including Quebec’s Act respecting the protection of personal information in the private sector (Law 25).
14. General
Language – These Terms are provided in English. A French version is also available. In case of any conflict between the two versions, the French version prevails for Quebec residents to the extent required by law.
Entire agreement – This Agreement, together with the general Terms of Use of The Oil Painting Hub, constitutes the entire agreement between you and us with respect to the Program and supersedes all prior discussions, representations, and agreements.
Severability – If any provision of this Agreement is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
No waiver – Our failure to enforce any provision of this Agreement will not constitute a waiver of our right to enforce that provision in the future.
Assignment – You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign this Agreement freely.
Notices – Notices to us must be sent to info@oph.art. Notices to you will be sent to the email address associated with your FluentAffiliate account.
Law and jurisdiction – This Agreement is governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising under this Agreement will be subject to the non-exclusive jurisdiction of the courts of Quebec.
